Article 1 – Definitions

  1. Cooling-off period: the period of 14 days during which you can exercise your right of withdrawal (also referred to as the “reflection period” or cooling-off period).
  2. Consumer: any natural person who is not acting for purposes relating to their trade, business, craft or profession, and who enters into a distance contract with the trader (referred to as “you” in these terms).
  3. Day: a calendar day.
  4. Durable medium: any tool that enables you or House of Tones to store information in a way that allows future reference and unaltered reproduction of the stored information (for example, e-mail).
  5. Right of withdrawal: the consumer’s option to cancel the distance contract within the cooling-off period of 14 days.
  6. Model withdrawal form: the standard European form for withdrawal, which House of Tones provides (or any other clear statement by you) to inform us of your decision to withdraw from the contract.
  7. Trader / House of Tones: the legal entity that offers products and/or services to consumers at a distance (in this case House of Tones B.V., also referred to as “House of Tones”, “we” or “us”).
  8. Distance contract: a contract concluded between House of Tones and a consumer in the context of an organized system for distance sales (such as an online webshop), whereby up to and including the moment of concluding the contract, exclusive use is made of one or more means of distance communication (e.g. via the website).

Article 3 – Applicability

  • These Terms & Conditions apply to every offer made by House of Tones and every distance contract and order between House of Tones and you (the consumer).
  • Before a distance contract is concluded, the text of these Terms & Conditions will be made available to you (for example, via a link on our website). If making the terms available in advance is not reasonably possible, we will indicate how you can review the Terms & Conditions electronically, or we will send them to you free of charge as soon as possible upon request.
  • Any deviations or additions to these Terms & Conditions are only valid if they have been explicitly agreed in writing or via email by House of Tones. Such deviations shall apply only to the specific contract in question.
  • If any provision of these Terms & Conditions is found to be void or invalid, it shall not affect the validity of the remaining provisions. The void or invalid provision will be replaced, by mutual agreement, by a provision that closely approximates the intent and economic effect of the original provision, to the extent permitted by law.
  • House of Tones is entitled to amend these Terms & Conditions from time to time. Changes will be announced on our website. The version of the Terms & Conditions in effect at the time of your purchase will apply to that purchase, unless you agree to a newer version after the change is made.
  • These Terms & Conditions are available in both Dutch and English. In the event of any discrepancy in interpretation between the language versions, the Dutch text shall prevail.

Article 4 – The offer

  • All offers made by House of Tones are without obligation. We reserve the right to refuse an order or to attach special conditions to the delivery, in accordance with the law, before a contract is concluded.
  • Each offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow you to make a proper assessment of the product. Any images of products are truthful representations of the actual products. Obvious mistakes or errors in the offer (for example, obvious misprints or pricing errors) are not binding on House of Tones.
  • Every offer clearly states the price including VAT, any applicable shipping or payment costs, the accepted methods of payment, and if applicable, the period for which the offer is valid or other specific conditions.
  • If an offer is subject to specific conditions or has a limited validity (for instance, a special promotion or limited-time sale), this will be explicitly mentioned in the offer.

Article 5 – The contract

  • The contract is concluded at the moment you accept the offer of House of Tones (for example, by placing an order through our website) and meet the conditions set for that offer. After you place an order, House of Tones will promptly confirm receipt of the order electronically (by email). As long as we have not sent a confirmation email, you can cancel the order without cost.
  • House of Tones takes appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment, especially for online payments. When you pay electronically, we will use secure protocols and encryption to keep your data safe.
  • Upon delivery of the product (or at the latest with the delivery confirmation email), House of Tones will provide you with the following information in writing or on another durable medium: a: the contact address of House of Tones (physical business address) where you can lodge complaints; b: the conditions under which and the methods by which you can exercise your right of withdrawal, or a clear statement if the right of withdrawal is not applicable (including, if relevant, the withdrawal form); c: information on warranties and existing after-sales services; d: a copy of or link to these Terms & Conditions, in case this was not provided before the conclusion of the contract.
  • Every contract is concluded under the suspensive condition of sufficient availability of the products ordered. If a product is unexpectedly out of stock or otherwise cannot be delivered, House of Tones will inform you as soon as possible and refund any amount already paid. House of Tones may, in consultation with you, offer a suitable alternative product. You are free to accept or decline such an alternative.

Article 6 – Right of withdrawal (cooling-off period)

  • Statutory cooling-off period: You have the right to cancel the purchase of a product within 14 days without giving any reason . This 14-day cooling-off period starts on the day: on which you (or a third party designated by you, other than the carrier) receive the product; if you ordered multiple products in one order and they are delivered separately: the day on which you receive the last product; if you ordered a product that consists of multiple shipments or parts: the day on which you receive the final shipment or the last part of the product.
  • Handling of the product during cooling-off period: During the cooling-off period, you should handle the product and its packaging with care. You may only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the product, as you would in a physical store . In other words, you can try the product to see if it meets your expectations, but you must not use it extensively if you intend to return it. You are liable for any diminished value of the product resulting from handling the product beyond what is necessary to evaluate it.
  • Exercising the right of withdrawal: If you choose to exercise your right of withdrawal, you must inform House of Tones within the 14-day cooling-off period. You may use the model withdrawal form (available on our website) or any other clear statement (e.g. an email) to do so. After notifying us of your decision to withdraw, you must return the product within 14 days thereafter. Please return the product with all delivered accessories, in the original condition and packaging if reasonably possible, and follow any reasonable return instructions provided by us.
  • Proof of timely withdrawal/return: It is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired, and send back the product within 14 days after that. We recommend that you keep proof of having sent your withdrawal notice (e.g. a copy of your email or letter) and proof of shipment of the returned product (e.g. a postal receipt or tracking number). If you do not timely notify us or fail to return the product on time, your right of withdrawal for that order may lapse.

Article 7 – Obligations upon withdrawal and costs

  • Costs of return shipment: If you exercise your right of withdrawal, you will bear the direct costs of returning the product (postage/shipping costs), unless we have agreed otherwise or we have explicitly stated that we will bear those costs . In other words, you are responsible for paying the return shipping, except in cases where we indicate that returns are free or at our expense.
  • Refund upon withdrawal: If you withdraw from the contract and have already made any payment, House of Tones will reimburse all payments received from you, including any standard delivery charges for the initial shipment, as soon as possible and in any case no later than 14 days from the day on which you informed us of your decision to withdraw . We may delay reimbursement until we have received the returned product back, or you have supplied evidence of having sent back the product, whichever is earlier . We will carry out the reimbursement using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees for the reimbursement. If you chose a more expensive delivery method than our standard delivery, we will only refund the cost of the standard delivery option (i.e., the cheapest method) .
  • Damaged packaging or product: Please ensure that you package any returned product carefully. If the returned product or its original packaging is visibly damaged or otherwise unsuitable for resale upon arrival at House of Tones, we reserve the right to deduct an amount for the loss in value. In case the product’s packaging is significantly damaged or missing, we will deduct 10% of the product’s price from your refund as compensation for the reduced resale value.
  • Damaged or misused device (Microcurrent Facial Device): For the Microcurrent Facial Device (facial treatment device), we have a specific condition: if this device is returned in a damaged condition or with clear signs of improper use, House of Tones reserves the right to hold you liable for the full loss of value. In practice, this means that if the device is severely damaged or appears to have been misused, you will not be eligible for a refund for that product . (Of course, normal use to test the device as permitted under the right of withdrawal is allowed, but any abuse or misuse beyond that may void your refund.)
  • After we receive and inspect your returned product, we will notify you if we determine that any loss of value has occurred due to your handling of the product. We will document and explain any such value reduction and the corresponding deduction from your refund.

Article 8 – Exclusion of the right of withdrawal

  • In principle, you can rely on the 14-day right of withdrawal for all products purchased from House of Tones. House of Tones will only exclude the right of withdrawal for products or services that are legally exempt from the withdrawal right , and only if we clearly inform you of such an exclusion prior to or at the conclusion of the contract. Examples of products and services for which the law permits exclusion of the cooling-off period include: a: Products that perish quickly or have a limited shelf-life. b: Products that are sealed for health or hygiene reasons and are not suitable for return once the seal is broken after delivery (for example, certain cosmetics or personal care items). c: Products that are made to order or clearly personalized according to your specifications. d: Sealed audio or video recordings and computer software, such as DVDs or software codes, if you have broken the seal after delivery. e: Digital content (e.g., downloads or streaming services) that is delivered immediately with your consent, whereby you waive your right of withdrawal once the performance has begun.
  • If House of Tones offers a product or service for which the right of withdrawal is excluded or not applicable, we will clearly indicate this in the offer. If you are unsure about whether a product can be returned, you can always contact us for clarification.

Article 9 – Prices

  • All prices for products and services indicated on our website or in our offers are in Euro (€) and inclusive of VAT. Any additional costs (such as shipping or payment fees) will be clearly specified before you place an order.
  • House of Tones reserves the right to adjust prices from time to time. However, the price stated in the offer at the time of purchase is the price that will apply to that order, except in the case of an obvious error. Price increases after the conclusion of the contract are not allowed, unless required by law (for example, a change in VAT rate). In the event a price is incorrectly displayed due to a mistake and this error is obvious (e.g., a technical error leading to a clearly implausible price), we are not obliged to fulfill the order at that erroneous price. We will inform you of the correct price and you will have the opportunity to cancel the order for a full refund if you do not wish to proceed at the correct price.
  • All stated prices are subject to misprints and typographical errors. We accept no liability for such errors. In case of printing or typographical errors in pricing, House of Tones is not obliged to deliver the product at the incorrect price.
  • Any promotions, discounts, or coupon codes are only valid during the period indicated and under the conditions stated for that promotion. Such promotions cannot be applied retroactively to orders placed outside the promotional period.

Article 10 – Conformity and warranty

  • House of Tones guarantees that the products comply with the contract, the specifications stated in the offer, reasonable standards of quality and usability, and any existing legal provisions and regulations on the date the contract was formed.
  • If an additional manufacturer’s warranty or commercial warranty is provided with a product (for example, by the manufacturer of the Microcurrent Facial Device), this is an extra service and does not affect the legal rights you have as a consumer . Any such extra guarantee is a promise that the product will meet certain standards or that you will receive certain remedies beyond your legal rights, but it does not limit your statutory rights under consumer law.
  • Legal warranty: As a consumer, you are entitled to a product that is in good condition and meets reasonable expectations. This means that in the EU you have a minimum two-year legal guarantee on the conformity of new goods . If a product is or becomes defective within that period due to a manufacturing fault or non-conformity that was present at the time of delivery, you are entitled to repair or replacement free of charge. In addition, under Dutch law, you may have rights to a remedy beyond two years if the product could reasonably be expected to last longer. If you experience an issue with a product, please contact us – even beyond the two-year period – and we will work with you to find an appropriate solution.
  • You are advised to report any visible defects or delivery errors (for example, if you received the wrong item or a product arrives damaged) to House of Tones as soon as possible, preferably within 2 months after discovery or receipt. We will then provide a suitable solution, which may include repair, replacement, or (partial) refund.
  • The warranty and your right to claim a free remedy do not apply if a product defect is the result of: misuse, deliberate or negligent damage, or use of the product contrary to its intended purpose or the instructions; changes or repairs made to the product by you or an unauthorized third party, without the written permission of House of Tones; normal wear and tear or aging of the product that arises from normal use.
  • For any questions or claims regarding product warranty, you can contact our customer service (see Article 2 for contact details). We aim to handle warranty claims within a reasonable timeframe and with minimal inconvenience to you.

Article 11 – Delivery and execution

  • House of Tones will exercise the utmost care when receiving and executing product orders. We will ensure proper packaging and send orders to the delivery address you provided.
  • We strive to dispatch accepted orders with due speed, and at the latest within 30 days, unless a different delivery period has been agreed upon . If delivery is delayed beyond the estimated time, or if an order cannot be fulfilled or can only be partially fulfilled, we will inform you no later than 30 days after you placed the order. In such cases, you have the right to cancel the contract without any cost. Upon cancellation due to such a delay, any amounts you have paid will be refunded to you.
  • All delivery times provided (for example, in our offer or order confirmation) are indicative. No rights can be derived from any stated delivery estimate . A stated delivery date is not a fatal deadline, and a delay in delivery does not entitle you to compensation. Of course, if we foresee a significant delay, we will inform you and you will have the options described above.
  • In the event of cancellation of the contract as described above (due to delay beyond 30 days or inability to deliver), House of Tones will refund the amount you have paid as soon as possible, but no later than 14 days after cancellation.
  • If delivery of an ordered product turns out to be impossible (for instance, if the product is out of stock or discontinued), House of Tones will endeavor to provide a replacement product of equal quality and value. At the latest upon delivery, we will clearly inform you that a replacement item is being delivered. You have the right to accept or refuse this replacement. In case of a replacement product, you still retain your right of withdrawal (cooling-off period) for that product, and returning the replacement product will be at our expense if you choose to withdraw from the purchase of the replacement.
  • The risk of damage or loss to products rests with House of Tones until the moment the products are delivered to you or a representative designated by you in advance. Once you or your designated third party (not the carrier) have taken physical possession of the goods, the risk transfers to you. If you return products to us within the scope of your right of withdrawal or warranty claim, the risk of loss or damage to the product during shipping remains with you until the product is received by House of Tones, unless we have instructed you to use a specific carrier or method which insures the shipment.

Article 12 – Ongoing contracts and subscriptions

House of Tones does not currently offer products or services by way of subscriptions or agreements of indefinite duration with recurring deliveries. Therefore, provisions regarding the termination or automatic renewal of long-term contracts are not applicable to our services at this time.

Article 13 – Payment

  • Unless otherwise agreed or stated, any amounts payable by you must be paid immediately and in full at the time of ordering. House of Tones provides secure electronic payment methods (such as iDEAL, credit card, etc.) which you can use during the checkout process. Your order will be processed and shipped only after we have received the payment in full.
  • In certain cases, House of Tones may offer you the option to pay (part of) the order amount after delivery (for example, via a third-party payment service that allows payment upon invoice). If such an option is provided and you choose it, the payment term is 14 days from the invoice date (or from the date of receipt of the product, as applicable). You are obliged to promptly report any inaccuracies in payment details you provided.
  • If you fail to meet your payment obligation(s) on time, we will send you a reminder and grant you a reasonable additional period to fulfill the obligation. If you still fail to pay within that additional period, House of Tones reserves the right, within legal limits, to charge you statutory interest on the outstanding amount, and to seek reimbursement of any extrajudicial collection costs that you were informed of in advance. This is without prejudice to any other rights we may have, such as the right to suspend or cancel the execution of the contract.
  • Until the purchase price is paid in full, House of Tones retains ownership of the delivered products. In case of late or non-payment, we may suspend further deliveries and/or rescind the agreement, in accordance with the law and these terms.

Article 14 – Complaints procedure

  • We strive for complete customer satisfaction. If you have any complaints about our products or services, please let us know. You can submit a complaint by contacting us via the contact information provided in Article 2 (preferably by email). Please describe the issue as clearly and completely as possible. Submit your complaint as soon as possible after discovering the problem (the sooner we know about it, the sooner we can help resolve it).
  • We will acknowledge and respond to your complaint within 14 days of receiving it. If a complaint requires a foreseeable longer time to investigate or resolve, we will send you an acknowledgment of receipt within 14 days and give an indication of when you can expect a more detailed response or resolution.
  • If we cannot resolve the complaint through our internal procedure, the dispute can be escalated as described in Article 15. We genuinely hope to find a mutually satisfactory solution before it reaches that stage.
  • If you have a complaint about a product or service purchased from House of Tones, you also have the option to submit your complaint via the European Online Dispute Resolution (ODR) platform. The ODR platform can be accessed at http://ec.europa.eu/odr. The ODR platform is an official website managed by the European Commission to help consumers and traders resolve disputes out of court. This option is especially relevant if you reside in another EU country.
  • Filing a complaint does not suspend your obligations to pay, if applicable, unless we confirm in writing that we are waiving or postponing a certain obligation pending the outcome of the complaint.
  • If a complaint is found to be justified by House of Tones, we will – at our discretion – either replace or repair the faulty product free of charge, or refund the purchase price for that product (in whole or in part, depending on the situation).

Article 15 – Disputes and governing law

  • Contracts between you and House of Tones to which these Terms & Conditions apply are exclusively governed by the laws of the Netherlands. This means that any disputes arising out of or relating to these contracts will be resolved under Dutch law. If you reside in a different country, you may also have the protection of the mandatory consumer protection laws of your country of residence, to the extent those laws provide additional rights beyond Dutch law.
  • In the event of a dispute that cannot be resolved amicably, you may bring the dispute before the competent Dutch court. If you are a consumer residing outside the Netherlands, you may also have the right to initiate proceedings in your country of residence under applicable international law. House of Tones will in principle adhere to the jurisdiction mandated by law.
  • The United Nations Convention on Contracts for the International Sale of Goods (CISG, "Vienna Sales Convention") does not apply to agreements with House of Tones.

Article 16 – Additional or deviating provisions

  • Any provisions that are supplemental to or deviate from these Terms & Conditions may not prejudice your rights as a consumer. Such provisions must be agreed in writing (including by electronic means) in a way that allows you to store them on a durable medium.
  • Where these Terms & Conditions refer to "in writing", this includes communication by email or other electronic means, provided the identity of the sender and the integrity of the message are sufficiently clear.
  • If these Terms & Conditions are provided in multiple languages, the Dutch version is binding in case of differences of interpretation.

Article 17 – Intellectual Property Rights

All content made available by House of Tones — including but not limited to product images, videos, designs, copywriting, promotional texts, and branded materials — is protected under international copyright and intellectual property law. This applies to content displayed on our website, social media platforms (including Instagram, TikTok, and Pinterest), and any other official communications.

Unauthorized use, reproduction, distribution, imitation, or adaptation of our content for commercial purposes is strictly prohibited. Any such infringement will result in immediate legal action, including but not limited to takedown notices, claims for damages, and formal legal proceedings.

Article 18 – Social Media Content Protection

All materials published on House of Tones’ social media channels are the exclusive property of House of Tones and are likewise protected by copyright and intellectual property rights.

  • This includes, without limitation:
    Instagram posts, Reels, and Stories
  • Captions and hashtags
  • Visual layouts and branding elements
  • Audio and video content
  • User-generated content created in collaboration with House of Tones

Any attempt to copy, repurpose, or exploit our social media content — especially in connection with competing products — constitutes an infringement of our IP rights and will trigger legal enforcement without prior notice.

Article 19 – 60-Day Satisfaction Guarantee (Money-back Trial)

House of Tones is confident in the quality and effectiveness of its products. Therefore, in addition to your 14-day statutory right of withdrawal, we offer a voluntary 60-day satisfaction guarantee on all our skincare products and devices. This means you can try our products risk-free for up to 60 days. If after using the product consistently for 60 days you are not satisfied with the results, you may be eligible for a full refund of the purchase price under the following conditions:

  • Trial period and proper use: You must actually use the product as directed for a continuous period of 60 days. Consistency is key – for example, if the product’s instructions say to use it daily, we expect that you have done so for the full 60 days. This guarantee is based on giving the product a fair chance to work as intended.
  • Before-and-after photos as evidence: To claim a refund under the 60-day money-back guarantee, you will need to provide evidence of your results. We ask that you take clear before and after photos of your skin (or the relevant area of use) to document the effect of the product. Take a photo before you start using the product, and another photo after 60 days of consistent use, under similar conditions (ideally with the same lighting and angle). These photos should be honest and unedited, and it’s helpful if they are date-stamped or can otherwise be verified for timing.
  • Submitting your claim: If you are not satisfied with the product’s results after 60 days of use and wish to invoke this guarantee, please contact us within 5 days after the end of the 60-day trial period. You can email us at support@houseoftones.nl with the subject “60-Day Money-Back Guarantee”, or use the contact form on our website. Please include your order number, the before and-after photos, and a brief description of your experience with the product.
  • Review and refund process: Once we receive your refund request with the required photos and information, House of Tones will review your submission. If your claim meets the above conditions and is approved, we will process your refund within 5–7 business days. The refund will be for the full purchase price of the product and will be issued to the same payment method that you used for the original purchase. We will notify you via email once your refund has been processed. There are no additional fees or charges for using this guarantee.
  • Fair use and exceptions: This satisfaction guarantee is offered in good faith to allow customers to try our products with confidence. House of Tones reserves the right to refuse a refund claim if we determine that the guarantee is being misused. Examples of misuse include: submitting a claim without genuinely using the product as directed for the full trial period, providing manipulated or falsified photos, or repeatedly claiming refunds on numerous products in a manner that suggests abuse of the policy. We will communicate with you if we have concerns about the validity of a claim.
  • Our goal is to be fair, so genuine and honest claims will be honored in accordance with these conditions.
  • Additional to legal rights: The 60-Day Satisfaction Guarantee is an extra service offered by House of Tones and does not affect your legal rights. You may choose to use either the standard 14-day right of withdrawal (if eligible) or this 60-day guarantee, or both, as applicable. For instance, if you decide within the first 14 days that the product is not for you and it is unused or lightly tried, you can opt to return it under the statutory right of withdrawal without needing to fulfill the conditions of the 60-day guarantee. Conversely, if you give the product the full 60-day trial and are not satisfied, this guarantee allows you a refund even though the normal withdrawal period has elapsed. This guarantee is intended to give you more peace of mind, not to limit your rights.
